The WELL Summit - Giveaway

The WELL Summit Giveaway (the “Giveaway”) sponsored by International WELL Building Institute pbc (“IWBI” or “Sponsor”) is subject to these official rules (the “Official Rules”). By entering the Giveaway, you acknowledge that you understand, meet, and comply with all such Official Rules and agree to be bound by them. If you do not agree and accept all of these Official Rules, or you are not eligible to enter, please do not submit an entry in the Giveaway.

This Giveaway is in no way sponsored, endorsed or administered by, or associated with, NeoCon® or Merchandise Mart Properties, Inc..

1. Entry Period. The Giveaway begins at 9:00am CDT on June 12, 2023 and ends at 3:00pm CDT on June 14, 2023 (the “Entry Period”).

2. Eligibility and Ineligibility

The Giveaway is only open to those individuals who are legal residents of one of the fifty (50) United States or the District of Columbia and who are at least eighteen (18) years old or older at the time of entry, are attending NeoCon® taking place June 12 through June 14, 2023 at THE MART in Chicago, Illinois (“the Event”) and who otherwise meet the requirements set out in these Official Rules. Employees, officers, directors and contractors of Sponsor and its parent, affiliate or subsidiary companies, and any of their respective agencies involved in the administration of any portion of the Giveaway, are not eligible to enter, nor are the immediate family members (meaning parents, children, siblings or spouses, whether biological, adopted, step or in-law) or household members (whether related or not) of such individuals.

The Giveaway is subject to all applicable state, federal and local laws and regulations and is void where prohibited by law.

Each entrant who submits an entry that meets the eligibility requirements is referred to herein as an “Entrant”.

3. Submitting an Entry

To submit an entry into the Giveaway, visit Sponsor’s booth at the Event and drop your business card or other form of identification into the collection bowl.

Only one (1) entry is permitted for any person.

4. Winner Selection and Prize

Sponsor will conduct a random drawing on or about June 14, 2023 from among all eligible entries received during the Entry Period. Odds of winning depend on the number of eligible entries received.

One winner (the “Winner”) will each receive one (1) prize (the “Prize”): a full credit against the registration fee for the 2023 WELL Summit, currently scheduled for September 25 and 26, 2023 in Washington, D.C. (the “WELL Summit”). The approximate retail value of the Prize is $650.

The Prize must be redeemed by the Winner prior to the WELL Summit. Any Prize not redeemed by such date shall be deemed forfeited.

The Prize does not include travel expenses, insurances of any kind, personal expenses, gratuities, incidental charges or any other costs not specifically described in these Official Rules as part of the Prize and will be the responsibility of the Winner.

5. Prize Conditions

The prize will be awarded in the name of the Winner if the Winner is verified as being an eligible winner in accordance with these Official Rules. In the event a dispute arises regarding a specific individual entitled to receive a prize, entries will be declared made by the applicable authorized account holder of the email account used at the time of entry.

The Winner does need not be present at Sponsor’s booth at the Winner announcement time. The Winner will be notified via email or text message, in each case to the contact information provided with the entry.

Prizes are non-transferable, and may not be substituted, except in Sponsor’s sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute another prize of equal or greater value. Non-cash prizes may not be redeemed for cash.

If a potential winner fails to complete, sign and return any requested documents within the designated time period, if a prize or prize notification is returned as undeliverable, if a potential winner fails to comply with any of the Official Rules, or if a potential winner is determined to be ineligible for any reason, the prize may be forfeited and awarded to an alternate, in Sponsor’s sole discretion.

If, for whatever reason, the WELL Summit is cancelled or postponed, the WELL Summit registration terms and conditions will govern, and Sponsor will have no further obligation to the Winner.

Sponsor reserves the right at its sole discretion, to disqualify any Entrant who takes part or attempts to take part in the Giveaway by any means contrary to the terms of these Official Rules and in such a way that presents an unfair advantage over other Entrants (such as, by tampering or computer hacking).

All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the Winner.

6. Conditions of Entry. By participating, entrants agree to these Official Rules, which are final and binding in all respects. All entries become the property of Sponsor and none will be returned. Sponsor’s decisions are final and binding in all matters relating to the Giveaway. Unless otherwise prohibited by law, acceptance of a prize constitutes permission to use Winner’s name, city and state of residence for advertising and publicity purposes, in any and all media, regarding the Giveaway, without additional compensation, notice or permission.

7. Limitation of Liability. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the processing of the entries. Sponsor reserves the right, in its sole discretion to modify, cancel or suspend the entire Giveaway, and randomly award the prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Giveaway. Sponsor reserves the right, in its sole discretion, to disqualify any individual (and their Giveaway entries) who tampers with the entry process. Automated entries are prohibited, and any use of such automated devices will result in disqualification. As a condition of entering and/or accepting a prize, entrants hereby agree: (i) to release Sponsor, and its parent, affiliate or subsidiary companies, and any of their respective agencies involved in the administration of any portion of the Giveaway, and each of their officers, directors, employees, contractors and agents (“Released Parties”), from any and all liability, loss or damage, including, without limitation, any tax liability, arising out of or in connection with the entrant’s participation in the Giveaway or the awarding, receipt, possession, and/or use or misuse of any prize; (ii) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (iii) all causes of action arising out of or connected with this Giveaway, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (iv) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.

8. Personal Data. By entering this Giveaway, you acknowledge and agree that Sponsor will process any personal information that you provide in connection with your submission to and participation in the Giveaway for the purpose of administering the Giveaway, including, without limitation, to verify eligibility, conduct the Giveaway, send notifications regarding the Giveaway, and, if applicable, deliver the Prize. You also acknowledge and agree that Sponsor may send you information about Sponsor’s programs that may be of interest to you. All personal information will also be subject to the Sponsor’s privacy policy.

9. Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the substantive laws of the State of New York without regard to any conflicts of law principles. All entrants consent to the exclusive jurisdiction and venue of New York County, New York for any litigation arising from the Giveaway or these Official Rules.

10. Winners. Sponsor will announce the Winners (first name and city only) on the @WELLcertified account on Instagram.
